Welcome to Wholly Health. By accessing or using our mobile application and services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account or using Wholly Health, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our services.

2. Medical Disclaimer

IMPORTANT: Wholly Health provides general wellness information and educational content. Our services are NOT a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read in our app.

3. Eligibility

You must be at least 13 years old to use Wholly Health. If you are under 18, you must have permission from a parent or legal guardian.

4. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

5. Free Trial and Subscriptions

Free Trial

New users receive a 7-day free trial with full access to all Premium features. At the end of the trial period, your access will be limited to the free tier unless you subscribe to a paid plan.

Subscriptions

Wholly Health offers auto-renewing subscriptions processed exclusively through Apple In-App Purchase. The following plans are available:

  • Premium Monthly — $14.99 per month
  • Premium Annual — $99.99 per year
  • VIP Monthly — $59.99 per month
  • VIP Annual — $499.99 per year

Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time in App Store Settings → Subscriptions.

Cancellation

You may cancel your subscription at any time through App Store Settings → Subscriptions. Cancellation takes effect at the end of the current billing period; you will retain access until that date.

Refunds

Refunds are handled in accordance with Apple's App Store refund policy. To request a refund, visit reportaproblem.apple.com.

6. User Content and Conduct

Your Content

You may submit content such as posts, comments, and photos ("User Content"). You retain ownership of your User Content, but grant us a license to use, display, and distribute it within our services.

Prohibited Conduct

You agree NOT to:

  • Post false, misleading, or harmful health information
  • Harass, bully, or threaten other users
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Attempt to hack, disrupt, or compromise our services
  • Use automated tools (bots, scrapers) without permission
  • Impersonate others or misrepresent your affiliation

7. Intellectual Property

All content, features, and functionality of Wholly Health (including text, graphics, logos, software) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or reverse engineer any part of our services without our written permission.

8. Third-Party Services

Our app may integrate with or link to third-party services (e.g., payment processors, analytics providers). We are not responsible for the content, privacy practices, or terms of these third parties.

9. Disclaimers and Limitations of Liability

No Warranties

Wholly Health is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, error-free, or secure.

Limitation of Liability

To the fullest extent permitted by law, Wholly Health and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

10. Indemnification

You agree to indemnify and hold harmless Wholly Health and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services or violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason. Upon termination, your right to use our services will immediately cease.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app or via email. Your continued use of our services after changes are posted constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

14. Dispute Resolution

Any disputes arising from these Terms or your use of Wholly Health shall be resolved through binding arbitration, except where prohibited by law.
